How Does an Agent Answer This Question?

Safe or dangerousIt is quite common for a buyer to ask about the safety of the neighborhood. The problem is that we agents should not render our interpretation of what is safe or what is not. A buyer may be asking if it okay for kids to ride bikes on the streets or play in their yards. Or on the flip side they may want to know if there has been recent crime in the neighborhood or sex offenders close by that are a menace.

Is This a Neighborhood Safe? My answer is pretty much the same each time. What I know for sure is that I will not render a personal opinion on the matter. I may know some facts but not all the facts so if I say I think it is pretty safe I had better be absolutely accurate. Since that is impossible, I will not recommend a neighborhood as being safe. 

Is This a Neighborhood Safe? First, I ask the buyer what their concerns might be so I can better direct them to get their questions answered. Anything from traffic count, to local crimes, to sex offenders can be found on registries and public sites. This is where I send them to look.

Is This a Neighborhood Safe? I also advise them to come back and looks at the neighborhood at different times during the day and night. They should talk to the neighbors in the community. The neighbors have opinions and love to share them especially about what goes on in the neighborhood.

I also recommend that they check the local police reports. These are public record.  It's easy to go online and get information and find out about registered sex offenders living in the community.

There is a fine line talking about the people in a neighborhood and what goes one and possible violating the federal fair housing laws. Steering buyers away from areas is also a Fair Housing violation.  

The best policy is to provide the websites for the buyers to check and get out of the way. Let them make a decision based on the facts of what they learn. That way you will have no possible violation of breaking real estate laws or Fair Housing Laws.

Excellent, our police department will supply a crime report on a neighborhood to a prospective buyer.

 A common question especially from transferring buyers...and calling th elocal district police station will give them alllllll the answers.

Debbie, definitely a question by many buyers, but it is their job to determine whether it is safe or not.

Hi Debbie... such a "sensitive" topic as with the question of demographics in a neighborhood that has to be handle with great tact to stay legal. Thanks for bringing it to attention. I've often discovered that buyers don't really know how many limitations we have on answering certain questions, but once they do, they understand.

Debbie your approach in answering this question is a good one.  The last thing a Realtor/Agent wants is to be brought up on charges of "steering".

Debbie Reynolds - the consumer's questions are valid. As you so poignantly described, it' not what you say but HOW you say it that keeps the agent out of hot water. People are always testing us and your guidelines will help agents pass the test.

Thank you for your post.  I agree they can always come on different day and time and drive around the neighborhood.  I also tell them to check with the local police department on any crime info that they are interested in.
